Order Vacating Entry of defaultOn June 5, 2007, the Clerk of Court entered a default against Defendant Sanford Wallace ("Defendant"). On June 11, 2007, Plaintiff MySpace, Inc ("Plaintiff") requested the court set aside the default because it anticiaptes that Defendant will move to set aside the default and Plaintiff wishes to avoid any delay associated with that motion. This request is currently set for hearing on July 2, 2007, but the Court finds the matter appropriate for submission without oral argument. See Fed. R. Civ. P 78; Local Rule 7-15. The Court hearby VACATES the hearing set for July 2, 2007 on this matter and hereby VACATES the default entered against Defendant on June 5, 2007.
