Aitken, et. al. v. Communications Workers of America, et al. [SETTLED]

On October 13, 2006, Verizon and twelve Verizon managers filed suit against certain unknown people for:

  • violation of the CAN-SPAM Act,
  • false endorsement, in violation of the Lanham Act
  • a state claim for misappropriation of the individual plaintiffs’ names,
  • a state claim for false light invasion of privacy,
  • a state claim for defamation,
  • a state claim for violation of Virginia’s anti-spam statute, and
  • a state claim for common law conspiracy.

The unknown people were affiliated with the Communications Workers of America and had created Yahoo! Mail accounts to send pro-union email to Verizon employees that appeared to be from certain managers at Verizon.

Most of the documents for this case are not available, but we have gotten a hold of an Opinion denying the Defendants' Motion to Dismiss the parts of the case alleging CAN-SPAM violations.
