Here's a practice note for all of you attorneys out there:

STOP USING THE "MY SPAM FOLDER ATE THE COURT'S NOTICE" DEFENSE!

Seriously. Don't do it. It's a dog of a strategy. Keep your deadlines, and don't blame your spam filter for your failure to do so.

This case is interesting because the attorneys involved are actually appealing the failure of the judge to accept their hungry spam folder defense to the 3rd Circuit Court of Appeals.

IANAL, but in the various enterprises in which I have been engaged (including "Life") I have pretty much had the responsibility of accounting for events that I could reasonable expected to expect.

Which is why I sometimes call the county office to say "I have not seen the bill for my car renewal...." or "you said you would send me a new apppointmet date....".

Are lawyers not bright enough to do that?

Since the company no longer exists, I think I could safely tell you about a "Bring Up" file system that we used at one place.

Or I could sell them an elderly Palm (genuine Palm Pilot).
