In this document, Soloway's attorneys try to make Dr. John Levine look as though he is befuddled by all of this spam stuff and also distinguish his case from that of Jeremy Jaynes.
IN THE UNITED STATES DISTRICT COURT FOR THE
THE SPAMHAUS PROJECT,
Stipulated ORDER for Permanent Injunction and Final Judgment as to Spear Systems, Inc., Bruce Parker, and Lisa Kimsey
The case against Spear Systems, Bruce Parker, and Lisa Kimsey is now over. They have settled for $29,000 and change, plus a promise to be good in the future.
That leaves this now as a case only against Xavier Ratielle and the other Canadian defendants.
Here is the First Amended Complaint in this case.
We have the addition of some new defendants: 9151-1154 Quebec (doing business as "Q Web"), 9064-9252 Quebec, HBE, and Abaragidan Gnanendran.
This is a motion to vacate the dismissal and force Linhardt and e360 to pay Susan Wilson's attorneys' fees.
This motion was denied on June 18, 2008.
MINUTE entry before the Honorable Virginia M. Kendall: Plaintiff's Motion for Voluntary Dismissal 47 is granted. Case is dismissed with prejudice. All pending deadlines and hearings are stricken. Civil case terminated. Mailed notice. (kw, ) (Entered: 06/04/2008)
Here is Soloway's response to the Government's Sentencing Memorandum.
Here is the Government's sentencing memorandum (with exhibits).
The government is requesting 9 years in prison and 3 years of probation. Plus, he will have to perform 624 hours of community service and be barred from Internet use (even at work) until discharged.
It's not going to be a good day for you anytime that a ruling starts off by calling your request "largely misguided".
I guess the money for all of this litigation is starting to run low. e360 is cutting this lawsuit loose with a voluntary motion to dismiss WITH PREJUDICE (meaning that they cannot refile the case later if they change their minds).
