I couldn't find this anywhere, so I asked the Virginia AG's office if they would kindly send me a copy of the Petition filed today. Just so you know what this Petition means in the scope of things: Nothing.
Reversal of ConvictionThe Virginia Supreme Court has overturned the conviction of Jeremy Jaynes saying that the "statute is unconstitutionally overbroad on its face because it prohibits the anonymous transmission of all unsolicited bulk e-mails including those containing political, religious or other speech protected by the First Amendment to the United States Constitution." ===================================
Commonwealth v. Jaynes [OVERTURNED]The Virginia Supreme Court, by a 4-3 decision, has upheld the 2004 felony conviction of Jeremy Jaynes (a/k/a Gaven Stubberfield) for violations of spamming sections of the Virginia Computer Crimes Act. The three dissenting justices would have accepted his First Amendment arguments and dismissed the case. That may be enough to send this on over to the federal side for more appeals.
